Those that do require an attorney are referred to affiliated immigration lawyers for handling and consultation. In much the same was as many people’s taxes do not need to be prepared by a CPA, and a professional tax preparer is all that is required; many immigration-related matters do not require total handling by an attorney. At Capitol Immigration every client’s file is, however, reviewed by an attorney.
Immigration applications, petitions and forms are complicated, time consuming and require a high-level of understanding of immigration regulations and procedures, as well as immigration terminology. It requires knowledge of the very “system” itself. While some applications that need to be submitted to the USCIS or U.S. Department of State can be done by an individual, it is almost always beneficial to have professional assistance. Even for a simple filing a mistake can add weeks or months to the process.
Immigration attorneys charge significantly higher consultation fees than professional firms that utilize both attorney and non-attorney immigration specialists, like Capitol Immigration. In some cases the services of an attorney, exclusively, are necessary; and, the additional money is very well spent to retain their services. But in the very large number of cases where an attorney is not required, the savings can be in the hundreds or even thousands of dollars.
When choosing an immigration firm, keep in mind the following:
- Can you see testimonials and references?
- Can you speak to former clients?
- Do you know all the fees you will be charged upfront?
- Will there will be any additional fees along the way?
- Do you know how long the process will take?
- Can the immigration firm handle your case? If not, can he/she refer you to an immigration attorney?
- Are the available to you when you need to have a question answered, or concern addressed?
- Last and most importantly, beware of promises that the firm or attorney can “guarantee” you the results you seek; or, that they have special “inside” connections at the USCIS. These claims are never truthful and are always a sure sign that you are being misled.
