Immigration Petition Through Employment

There are several government agencies involved with granting permission for foreign workers to work in the U.S. First, employers must seek certification through the Department of Labor (DOL). Once the application is certified/approved the employer must petition the Immigration and Naturalization Service (INS) for a Visa. Approval by DOL does not guarantee a visa issuance. Applicants must also establish that they are admissible.

The Labor certification is the process that most foreign workers must undergo to obtain permanent residency. Foreign labor certification is generally designed to assure that the admission of foreign workers to work in the United States on a permanent or temporary basis will not adversely affect the job opportunities, wages and working conditions of American workers. Under the Department of Labor's 1996 changes, there are two procedures for processing Labor Certifications: (1) the traditional Labor Certification and (2) Reduction in Recruitment.

By and large, with some limited exceptions, two years of experience in a skilled occupation is a minimum prerequisite to become labor certified. You do not have to be a "rocket scientist" to obtain satisfaction. As a matter of fact, professions such as:

Secretary, Rug Repairer, Transmission Mechanic, Tester (Food Products) Auto Mechanic, Machinist, Chef, Electronic Sales & Service technician, Marble Setter, Cosmetologist, Jeweler, Buyer, Carpet Layer, Civil Engineer, Coach (Professional Athletes) Neon Sign Service, Automobile Body Repair, Medical Laboratory Technician, Hotel Clerk, Diamond Selector, Medical Secretary, Diesel Mechanic, Expert Insurance Service, Cable Television Installer, Drapery And Upholstery Measurer, Electrical Technician, Accountant, Bookkeeper, Cooks, Dental Assistants, Nursing, Medical Personal, Engineer, Computers, Board And Care Managers, Managerial Positions And Many others have qualified and still qualify for the Labor Certification process. In other words, you may qualify to get your Green Card through your occupation.
