H-1B classification applies to persons in a specialty occupation, which requires the theoretical and practical application of a body of highly specialized knowledge requiring completion of a specific course of higher education. This usually means a four-year degree and possibly a combination of experience and education. This classification requires a labor attestation issued by the Secretary of Labor.
In order to be considered as a nonimmigrant in the H-1B classification, the applicant's prospective employer or agent must file a Petition for Nonimmigrant Worker with the United States Bureau of Citizenship and Immigration Services in the Department of Homeland Security (BCIS). Once approved, the employer or agent is sent a notice of approval. It is not possible to apply for an H1B visa without an employer.
There MUST be an employer who desires to employ the applicant.
This visa is set aside for "professionals". This visa is the most regulated of the employment visas. Applicants must have a U.S. job offer. According to federal regulations, the job to be filled by the foreign worker must require the services of a professional.
For immigration purposes, a professional is defined as someone with a United States four-year Bachelors degree or the equivalent. If the foreign worker's education is not the equivalent of a U.S. four-year Bachelors degree, the person's experience can be factored into the determination. If the minimum requirement for entry into the field is a Bachelors degree, then the position is considered to be professional in nature.
Duration of the visa:
H-1B1 Up to 3 years May be renewed in 3-year increments. Maximum stay is 6 years.
Dependents of H1B:
Will get an H4. Dependents of an H1B visa holder can go to school, but will not obtain a work permit.
How to qualify for an H-1B
- In order to qualify for an H-1B you must have the appropriate degree for the specified job or 12 years of specifically qualifying experience. The degree, or the experience, must be the equivalent of a U.S. bachelor’s degree.
- You need a job offer from a company that is willing to sponsor you for an H-1B Visa. Without the sponsorship of a company, no visa can be granted.
- The company that is sponsoring you has to file a Labor Condition application with the Department of Labor.
- After approval of the labor condition application, the employer has to file an H-1B petition.
- If you already are in the U.S legally, your status will be changed to H-1B. If you live abroad, you will have to go to the U.S. consulate of your home country, and obtain the visa in your passport.
- It takes several weeks to several months until your H-1B visa is issued.
- There is a cap on the number of H-1B visas that can be issued in a year. The fiscal year begins October 1st. The cap is often reached in a few months. Do not delay. It may be in your best interest to start the process now.
