Intra Company Transfer

The nonimmigrant visa category was established as a useful tool for international companies needing to bring foreign employees to the United States to work for a limited period of time. The maximum initial period of stay is three years and may be extended up to 7 years.

Provided the company is very successful and employs higher level employees i.e. in a managerial capacity, it is possible to obtain a Green Card without undergoing the Labor Certification process.

The main conditions are:

  • In the foreign country, the company must be an existing company doing substantial business
  • The employee must have worked at least one year
  • The company must have several employees
  • The company must have been paying taxes
  • In the creation of a company in the United States
